It shall be deemed to be a public nuisance if any property owner, lessee or occupant maintains any stable, shed, pen or other place where horses, cattle, sheep, goats or other similar animals, excluding cats and dogs, are kept, or who shall permit the same to remain unclean to the annoyance of any citizen in the City of Riley, Kansas.

It shall be unlawful for any person to keep, maintain or have in his or her possession, or under his or her control within the City of Riley, Kansas, any poisonous reptile or any other dangerous or wild animal or reptile, or any vicious or dangerous domesticated animal or any other animal or reptile with wild, vicious or dangerous propensities.

This article shall not be construed to authorize the keeping or maintaining of any domestic animal, livestock or fowl on any premises within the City of Riley, Kansas, under any condition which constitutes a public nuisance. The City Council for the City of Riley, Kansas, shall be authorized to abate any animal nuisance as provided by law, including but not limited to, requesting injunctive relief in the District Court of Riley County, Kansas.

Any person who shall allow any animal to habitually remain or to lodge or to be fed within his home, store, yard, enclosure or place, shall be deemed and considered as keeping and harboring within the meaning of this article.

(a) Fowl shall mean those domestic birds commonly kept for the production of meat, eggs or feathers. This shall include chickens, ducks, turkeys, geese, swans, peafowl, and guinea fowl, ostriches and emus.
(b) Permitted fowl shall mean female chickens. It shall be lawful to own or keep permitted fowl, within the City. The maximum total number of permitted fowl allowed to be owned or kept per person or household is 8.

It shall be unlawful for any person to allow permitted fowl to run or be at large at any time in the city. For the purpose of this section, the term “at large” shall be defined to include those times during which any permitted fowl shall not be confined or kept in pens sufficiently strong or constructed to keep such fowl on the premises of their owner or keeper.

A person desiring to keep permitted fowl in the city shall apply for a permit to do so and the governing body will consider whether such permit should be granted. A permit granted pursuant to this section shall be reviewed annually by the governing body at the April regular meeting of the governing body and said permit may be renewed or cancelled at that time. The governing body reserves the right to revoke a permit at any time.
