The purpose of this article is to protect public health, safety, and the environment by prohibiting the illegal dumping of materials at the City of Riley landfill. This article is enacted in accordance with the authority granted under Kansas law, and shall be enforced by the City’s Code Enforcement Officer.

Illegal dumping means the disposal, discarding, or placing of any solid waste, hazardous waste, or other material at the city landfill:
(a) without prior approval of the landfill operator;
(b) outside of normal operating hours;
(c) in violation of any posted landfill rules; or
(d) of a type not accepted under city or state regulations.
Solid waste includes garbage, refuse, and other discarded materials as defined in K.S.A. 65-3402.
Hazardous waste means waste designated as hazardous by KDHE or Kansas Statute.
Landfill refers to any municipal solid waste disposal facility owned or operated by the City of Riley.
Code Enforcement Officer means the designated city official responsible for enforcing municipal codes and ordinances.

It shall be unlawful for any person, firm, corporation, or entity to:
(a) Dump, deposit, discard, or otherwise dispose of any solid or hazardous waste at the city landfill except in full compliance with:
(1) posted rules and signage;
(2) the landfill’s accepted material guidelines; and
(3) directions of authorized landfill personnel during operating hours.
(b) Deposit any materials that are prohibited under Kansas Department of Health and Environment (KDHE) regulations or the City’s landfill policy.

Any person who violates this article shall be guilty of a municipal offense and, upon issuance of a citation by the Code Enforcement Officer and conviction in Municipal Court, shall be subject to a minimum fine of One Hundred Dollars ($100) and a maximum fine of Five Hundred Dollars ($500) for each separate offense.

The Code Enforcement Officer of the City of Riley is hereby authorized and directed to enforce the provisions of this article. The Code Enforcement Officer may issue citations, notices of violation, or take any necessary enforcement actions consistent with municipal procedures and Kansas law. The City may also seek reimbursement for cleanup or remediation costs associated with illegal dumping when applicable.
